Terms of Service

These Terms of Service ("Terms") govern your use of Apex, the interview-preparation platform operated by Apex ("we," "us," or "our"). By creating an account or using Apex, you agree to these Terms.

Eligibility

You must be at least 13 years old to use Apex. By using Apex, you represent that you meet this requirement and that any information you provide is accurate.

Your account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.
• We may suspend or terminate accounts that violate these Terms, misuse the platform, or engage in fraudulent activity.

Subscriptions and billing

• Apex offers a Free plan and paid subscription tiers (Pro and Recruiting Pass), billed monthly or weekly as selected at checkout.
• Subscriptions purchased via the Apex website are billed through Stripe. Subscriptions purchased via the iOS app are billed through Apple and are subject to Apple's terms.
• Subscriptions automatically renew until cancelled. You can cancel anytime through your account settings (web) or your Apple ID subscription settings (iOS); cancellation takes effect at the end of the current billing period.
• Fees are non-refundable except where required by law or, for iOS purchases, in accordance with Apple's refund policies.
• We may change pricing with advance notice; continued use after a price change constitutes acceptance.

Acceptable use

You agree not to:

• Share your account or resell access to Apex.
• Scrape, copy, or redistribute Apex's question bank or content.
• Use Apex to harass other users or post abusive, discriminatory, or illegal content in social features.
• Attempt to reverse-engineer, disrupt, or gain unauthorized access to Apex's systems.
• Use automated tools to generate practice answers in place of your own work.

AI-generated feedback

Apex uses AI to grade practice answers and generate feedback. Grades and feedback are provided for practice and educational purposes only. Apex does not guarantee interview outcomes, job offers, or the accuracy of every AI-generated response, and feedback should not be treated as professional financial or career advice.

Content you submit

You retain ownership of the answers, posts, and other content you submit. By submitting content, you grant Apex a license to store, process, and display it as necessary to operate the platform, including showing your activity to other users if you enable social features.

Third-party integrations

Apex offers optional integrations with third-party services, such as connecting your Google account for Calendar and Gmail features in My Network. These integrations are opt-in, and you can disconnect them at any time in Settings → Connectors. Your use of a connected third-party service is also subject to that service's own terms; Apex is not responsible for the availability, accuracy, or content of third-party services.

Intellectual property

Apex's question bank, software, design, and branding are owned by Apex and protected by intellectual property law. You may not copy, modify, or distribute them without permission.

Termination

You may stop using Apex and delete your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use Apex ends immediately; provisions that by their nature should survive (such as intellectual property and limitation of liability) will continue to apply.

Disclaimers

Apex is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that it will result in any particular interview or recruiting outcome.

Limitation of liability

To the maximum extent permitted by law, Apex will not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice before the changes take effect. Continued use of Apex after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
